2. Case Law

- A cause of action accrues as soon as the party in whose favor it arises is entitled to maintain an action (11ROP74).


- Trial court cannot raise issue of statute of limitations (SoL); SoL is an affirmative defense that must be raised by the parties. Failure to raise it constitutes waiver. (1ROP587).


- Filing a claim that is obviously barred by res judicata, collateral estoppel or SoL may subject a litigant to sanctions (7ROP76).
